Digital Millennium Copyright Act (DMCA) Policy

1. Introduction

ServerAtelier UG (haftungsbeschränkt) (“ServerAtelier”, “we”, “us”, or “our”) respects the intellectual property rights of others and expects its customers to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how we respond to claims of copyright infringement relating to content hosted on our infrastructure.

ServerAtelier provides hosting and infrastructure services, including game server hosting, on servers located in the United States (Dallas, Texas). Although ServerAtelier is a European company, U.S. copyright law may apply to content hosted on servers physically located in the United States.

This policy is intended to comply with the requirements of the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512.


2. Role of ServerAtelier

ServerAtelier acts as a technical service provider and hosting provider. We do not create, upload, modify, or actively monitor customer content. All content hosted on our systems is provided, controlled, and managed solely by our customers.

ServerAtelier does not proactively monitor hosted content for copyright infringement. However, upon receiving a valid DMCA notice, we will take appropriate action as required by law.


3. Submitting a DMCA Takedown Notice

If you believe that copyrighted material is being hosted on ServerAtelier’s infrastructure without authorization, you may submit a written DMCA takedown notice.

To be valid, your notice must include all of the following information, as required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material and sufficient information to allow us to locate it (such as IP address, server identifier, file path, or other technical details).
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete or invalid notices may be rejected or delayed.

4. Takedown Procedure

Upon receipt of a valid DMCA takedown notice, ServerAtelier will:

  • Promptly review the notice for legal sufficiency
  • Remove or disable access to the allegedly infringing material where technically feasible
  • Notify the affected customer of the takedown

ServerAtelier aims to process valid notices as quickly as reasonably possible, typically within 24 to 48 hours.


5. Counter-Notification

If a customer believes that their content was removed or disabled as a result of mistake or misidentification, they may submit a counter-notification.

A valid counter-notification must include:

  • The customer’s physical or electronic signature.
  • Identification of the material that has been removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that the customer has a good-faith belief that the material was removed or disabled due to mistake or misidentification.
  • The customer’s name, address, telephone number, and email address.
  • A statement consenting to the jurisdiction of a U.S. Federal District Court and agreeing to accept service of process from the original complainant.

Upon receipt of a valid counter-notification, ServerAtelier may forward it to the original complainant. Unless we receive notice that legal action has been initiated, the material may be restored within 10 to 14 business days, where technically feasible.


6. Repeat Infringer Policy

ServerAtelier maintains a policy to address repeat copyright infringements. Customers who repeatedly submit or host infringing content may have their services suspended or terminated at our sole discretion.

This policy applies regardless of whether the infringement was intentional or negligent.


7. False or Abusive Claims

Submitting knowingly false, misleading, or abusive DMCA notices or counter-notifications may result in legal liability under applicable law. ServerAtelier reserves the right to reject notices that appear to be fraudulent, incomplete, or submitted in bad faith.


8. Data Retention After Service Termination

Customer content is retained for a maximum of three (3) days after the service due date. After this period, all remaining data is permanently deleted from our systems. This retention period applies independently of any DMCA process and is intended solely for operational and customer-service purposes.
